Dentist Kin Fong
Dentist Kin Fong of Smile Design Ottawa has pled guilty to tax fraud and money laundering in relation to his participation in a detax scheme. Fong has been handed a conditional sentence of two years less a day including 12-months house arrest and is paying back the $500,000+ in taxes he defrauded.
Fong was involved in the criminal Paradigm Education Group tax fraud schemes cooked up by Russell Porisky who was himself sentenced to 5.5 years in jail and fined $260,000 for tax fraud. Fong is merely the latest individual involved in the Organized Pseudolegal Commercial Argument milieu to find out that both death and taxes are certainties in life.
Fong practiced at his Smile Design Ottawa dentist office.
The Ottawa Citizen reports that the College of Dental Surgeons is scrambling to get the facts. That’s odd, because I reported Fong to them on August 1st, 2018 as a result of his detax activities. You’d think CRA accompanied by the RCMP conducting raids on Fong’s home and office in 2015 would spark the College’s interest as the professional regulator. I tried to warn them it would end in tears…

My complaint is as follows:
If it has not already come to your attention, I am writing to express my concern that this dentist has become actively involved in organized efforts to avoid his legal obligations under the Income Tax Act in relation to his dental practice. The Courts have described such unlawful efforts as “Organized Pseudolegal Commercial Argument” or OPCA (see: Meads v. Meads, 2012 ABQB 571 (CanLII),

In legal filings to the Supreme Court of Canada (copy attached), Mr. Fong makes standard OPCA-style arguments against his obligations to properly pay his income tax and file his tax returns that have repeatedly been rejected by the Courts and it is clear that this was pointed out to him. Mr. Fong indicates at page 32 of the attached document that his actions resulted in the simultaneous execution of search warrants at both his dental practice and home by Canada Revenue Agents accompanied by the RCMP on 16 June 2015.
Given the materials filed by Mr. Fong in the attached document, I am concerned that this displays a lack of professional integrity and ethics that reflects negatively on him and calls into question his fitness as a member of the College of Dental Surgeons of Ontario.
I would ask that my concerns be investigated and appropriate disciplinary action taken.
